Under the GDPR, people have the right of access to request a copy of their collected personal data. The GDPR also seeks to hold businesses accountable for how they use consumer data.\u00a0<\/p>\n\n<p class=\"wp-block-paragraph\">When GDPR applies depends on whether your organization processes personal data of individuals in the EU, even if your business\u00a0operates\u00a0outside the region.\u00a0<\/p>\n\n<p class=\"wp-block-paragraph\">Even if your business isn\u2019t based in Europe, you have a legal obligation to be GDPR compliant if you interact with data from persons in the EU. For example, let\u2019s say you\u2019re an American company with email subscribers in Denmark. Since your company interacts with the personal data of an EU resident, you\u2019re required to be GDPR compliant.\u00a0<\/p>\n\n<p class=\"wp-block-paragraph\">This obligation also includes\u00a0designating\u00a0a Data Protection Officer (DPO) if your core activities involve large-scale monitoring or processing of special categories of data, such as health or biometric data. The DPO oversees compliance efforts and acts as a contact point for your local Supervisory Authority.\u00a0<\/p>\n\n<p class=\"wp-block-paragraph\"><b>Non-compliance results in <\/b><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:32016R0679#d1e6226-1-1\" target=\"_tabs\" rel=\"noopener noreferrer\"><u><b>hefty fines<\/b><\/u><\/a><b>.<\/b> Penalties go up to either 20 million euros or 4% of your global annual revenue \u2013 whichever is higher. In addition, individuals whose data you\u2019ve collected or processed have the right to seek compensation for damages.<\/p>\n\n<p class=\"wp-block-paragraph\">With so much at stake, let\u2019s dig into the GDPR requirements to make sure you get this right. Below, we\u2019ll walk through a brief history of the GDPR, go over some key terms and definitions, discuss how you can meet GDPR compliance, and what Mailgun is doing to stay GDPR compliant as well.\u00a0<\/p>\n\n<h2 class=\"wp-block-heading\">What\u2019s the history of the GDPR?<\/h2>\n\n<p class=\"wp-block-paragraph\">Data breaches and misuse have spread like wildfire in the past decade. High-profile social media cases like the <a href=\"https:\/\/www.nytimes.com\/2018\/04\/04\/us\/politics\/cambridge-analytica-scandal-fallout.html\" target=\"_tabs\" rel=\"noopener noreferrer\"><u>Cambridge Analytica scandal<\/u><\/a> have raised large-scale public interest in cybersecurity and data privacy.<\/p>\n\n<p class=\"wp-block-paragraph\">Though the 1995 EU Data Protection Directive laid the groundwork for data privacy, EU lawmakers continued to negotiate for uniform rules across all member states to safeguard personal data protection. The European Parliament successfully passed the GDPR in 2016, and as of <b>May 25, 2018<\/b>, the regulations have been actively enforced by each country\u2019s\u00a0Data Protection Authority (DPA)\u00a0or\u00a0Supervisory Authority.<\/p>\n\n<p class=\"wp-block-paragraph\">Since then, the GDPR has inspired similar data protection principles and information security regulations in many countries outside of the EU, including Argentina, Brazil, Chile, Japan, Mauritius, South Africa, South Korea, and Turkey. In addition, the United Kingdom\u2019s <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2018\/12\/contents\/enacted\" target=\"_tabs\" rel=\"noopener noreferrer\"><u>Data Protection Act<\/u><\/a> and the <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201720180AB375\" target=\"_tabs\" rel=\"noopener noreferrer\"><u>California Consumer Privacy Act (CCPA)<\/u><\/a> share many similarities with the GDPR.<\/p>\n\n<p class=\"wp-block-paragraph\">The GDPR and similar laws are becoming the new gold standard for consumer data protection.<\/p>\n\n<h2 class=\"wp-block-heading\">What are some criticisms of the GDPR?<\/h2>\n\n<p class=\"wp-block-paragraph\">Even though the GDPR has raised the bar for data security, it\u2019s faced the following <a href=\"https:\/\/www.svensktnaringsliv.se\/material\/skrivelser\/xf8sub_whats-wrong-with-the-gdpr-webbpdf_1005076.html\/What%27s+wrong+with+the+GDPR+Webb.pdf\" target=\"_tabs\" rel=\"noopener noreferrer\"><u>criticisms<\/u><\/a> since its adoption:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The GDPR is vague and difficult to interpret.<\/li>\n\n\n\n<li>The GDPR isn\u2019t\u00a0 uniformly enforced. As a regulation, the interpretation and enforcement of the GDPR are left to EU member states.<\/li>\n\n\n\n<li>Older data protection regulations in EU member states produce contradictory standards which are difficult for international businesses to follow.<\/li>\n\n\n\n<li>The GDPR lacks guidance and uncertainty for international data flows.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Some businesses also note the administrative burden of appointing a DPO and performing Data Protection Impact Assessments (DPIAs), which are\u00a0required\u00a0when\u00a0new technologies\u00a0or large-scale processing could pose high risks to individual rights.<\/p>\n\n<h2 class=\"wp-block-heading\">What are some key concepts in the GDPR?<\/h2>\n\n<p class=\"wp-block-paragraph\">The GDPR is 88 pages long and filled with legalese. Let\u2019s start by looking at some key concepts to understand GDPR compliance.<\/p>\n\n<h3 class=\"wp-block-heading\">What is a natural person?<\/h3>\n\n<p class=\"wp-block-paragraph\">A natural person is<b> <\/b>any individual human being. In legal speak, \u201cnatural person\u201d is used to distinguish from a \u201clegal person,\u201d which can be a private organization such as a company or public organization like the government. A legal person is not a human being. For instance, you, your subscribers, and your users are all natural persons. The GDPR seeks to protect the rights of natural persons.<\/p>\n\n<h3 class=\"wp-block-heading\">What is personally identifiable information (PII)?<\/h3>\n\n<p class=\"wp-block-paragraph\">The GDPR centers around the protection of personally identifiable information (PII). PII is any personal data that can be used to identify a natural person. In your business practices, you might interact with some types of PII, including names, email addresses, location information, IP addresses, biometric data, genetic data, political opinions, religious beliefs, and gender.<\/p>\n\n<h3 class=\"wp-block-heading\">What is data processing?<\/h3>\n\n<p class=\"wp-block-paragraph\">Data processing is any action that is performed on data. These actions include data collection, recording, organization, structuring, storing, erasure, or usage. The GDPR regulates data processing to ensure that companies provide more transparency about how they collect and use consumer PII.<\/p>\n\n<h3 class=\"wp-block-heading\">What is a data subject?<\/h3>\n\n<p class=\"wp-block-paragraph\">The GDPR defines a data subject as a natural person whose PII is processed. If your subscribers and users provide you with their PII, such as names and email addresses, they are your data subjects.<\/p>\n\n<h3 class=\"wp-block-heading\">What is a data controller?<\/h3>\n\n<p class=\"wp-block-paragraph\">A data controller is the decision-maker for why and how PII is processed; you\u2019re considered a data controller if you interact with unique details about your users.<\/p>\n\n<h3 class=\"wp-block-heading\">What is a data processor?<\/h3>\n\n<p class=\"wp-block-paragraph\">A data processor is a third party, like Mailgun, that conducts data processing activities on behalf of a data controller. Sometimes, data processors can\u2019t process personal data independently and rely on sub-processors to do the heavy lifting. The same GDPR compliance principles bind sub-processors as the main data processor. At Mailgun, we use sub-processors such as Amazon Web Services, Rackspace, Google Cloud Platform, and Softlayer. These entities provide the underlying infrastructure on which we host Mailgun and also must be GDPR compliant.<\/p>\n\n<p class=\"wp-block-paragraph\">As you can see, the GDPR impacts your business practices since you collect and process data as part of your email campaigns. Let\u2019s take a look at the data protection principles laid out in the GDPR so you can remain compliant.<\/p>\n\n<h2 class=\"wp-block-heading\">What are the data protection principles in the GDPR?<\/h2>\n\n<p class=\"wp-block-paragraph\">The GDPR lays out seven data protection and data accountability principles that data controllers and data processors must follow to be GDPR compliant:<\/p>\n\n<ol class=\"wp-block-list\">\n<li><b>Lawfulness, fairness, and transparency<\/b>: You must process data in a lawful, fair, and transparent way to the data subject.<\/li>\n\n\n\n<li><b>Purpose limitation:<\/b> You must process data for legitimate interests for conducting your business. When you collect their PII, you must explicitly specify these purposes to the data subject.<\/li>\n\n\n\n<li><b>Data minimization: <\/b>You should minimize the amount of data you collect and process for your legitimate interests.<\/li>\n\n\n\n<li><b>Accuracy:<\/b> You must keep PII accurate and up to date.<\/li>\n\n\n\n<li><b>Storage limitation: <\/b>You may only store PII as long as it is necessary for the specified purpose.<\/li>\n\n\n\n<li><b>Integrity and confidentiality:<\/b> You must securely process PII to ensure its integrity and confidentiality. For instance, you can use end-to-end encryption and other organizational measures to prevent unauthorized access.<\/li>\n\n\n\n<li><b>Accountability: <\/b>Data controllers and data processors are responsible for demonstrating GDPR compliance with all of these principles.<\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\">In addition to these data protection principles, the GDPR also lays out specific rights for data subjects.<\/p>\n\n<h2 class=\"wp-block-heading\">What rights do data subjects have under the GDPR?<\/h2>\n\n<p class=\"wp-block-paragraph\">As a data controller or data processor, it\u2019s essential to be aware of the rights of data subjects from whom you collect personal data. The GDPR lists the following rights, which give data subjects more control over the personal data that they loan to service providers:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The right to be informed<\/li>\n\n\n\n<li>The right of access<\/li>\n\n\n\n<li>The right to rectification<\/li>\n\n\n\n<li>The right to erasure, a.k.a. the right to be forgotten<\/li>\n\n\n\n<li>The right to restrict processing<\/li>\n\n\n\n<li>The right to data portability<\/li>\n\n\n\n<li>The right to object<\/li>\n\n\n\n<li>Rights concerning automated decision-making and profiling<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Keeping these rights in mind, we\u2019ll go through some best practices to meet GDPR compliance as a data controller.<\/p>\n\n<h2 class=\"wp-block-heading\">What does the GDPR mean for data controllers?<\/h2>\n\n<p class=\"wp-block-paragraph\">In the GDPR jargon, anyone that collects PII is considered a data controller. Do you save unique details about your contacts like their location, home address, phone number, or email? If so, you\u2019re a data controller.<\/p>\n\n<p class=\"wp-block-paragraph\">As a data controller, you must follow the data protection principles above. You have two primary responsibilities: full disclosure and transparency.<\/p>\n\n<h3 class=\"wp-block-heading\">What are some best practices to provide full disclosure?<\/h3>\n\n<p class=\"wp-block-paragraph\">You need to fully disclose that you\u2019re collecting PII every time you ask your users or subscribers to provide their personal data. In addition, you must let your users know why you need the personal data that they provide. We know that data and analytics superpower your business, but if you can\u2019t specify why you need a particular piece of personal data, it\u2019s probably best not to ask for it.<\/p>\n\n<p class=\"wp-block-paragraph\">In some cases, you can use <a href=\"https:\/\/www.mailgun.com\/de\/blog\/pseudonymization-and-you-optimizing-data-protection\" target=\"_tabs\" rel=\"noopener noreferrer\"><u><b>pseudonymization<\/b><\/u><\/a><b> techniques<\/b> that make it harder to identify a person from their individual contact attributes. Pseudonymization masks values in your database to hide the data subject&#8217;s identity, focusing instead on values that are easy to find from other sources.\u00a0<\/p>\n\n<p class=\"wp-block-paragraph\">Keep in mind, pseudonymization isn\u2019t sufficient on its own. However, you can pair it with other security measures, like <b>end-to-end encryption<\/b>. Even with these extra measures, there\u2019s still the risk that someone can work backward from the PII to identify the data subject. As such, proper disclosure to your data subjects is necessary for GDPR compliance.<\/p>\n\n<h3 class=\"wp-block-heading\">What are some best practices to maintain transparency?<\/h3>\n\n<p class=\"wp-block-paragraph\">As a data controller, you also must maintain transparency. You need to make sure that data subjects knowingly consent to have their personal data collected and processed. You can use <a href=\"https:\/\/www.mailgun.com\/de\/blog\/deliverability\/eine-email-liste-richtig-aufbauen\/\" target=\"_tabs\" rel=\"noopener noreferrer\"><u>double opt-in measures<\/u><\/a> to be sure that your users want to receive emails from you. After receiving this explicit consent, follow up with clear consent statements for each interaction with your user.<\/p>\n\n<p class=\"wp-block-paragraph\">Lastly, make sure to provide data subjects with an obvious and readily available option to remove their consent for further data collection or processing.
